Not sure if you are citing (1) as evidence of over-active government, or just an item of interest–but I gotta say I don't blame the courts in this instance. If more parents had to pay a fine when their kids vandalized other people's property, there very likely wouldn't be as much graffiti on our streets. I think this should be automatic, in fact. They tried doing this in my locale a few years back but the parents all complained that it was discrimination and it was shelved.
