>>The Supreme Court Speaks: Free Enterprise Fund v. PCAOB

This week, after nearly five years, the U.S. Supreme Court handed down its decision in CEI’s challenge to the Sarbanes-Oxley corporate accounting law and the quasi-government enforcement entity it spawned, the Public Company Accounting Oversight Board. The court found that the PCAOB violated the Separation of Powers clause of the U.S. Constitution, by impermissibly insulating the members of the board from removal by the Securities and Exchange Commissioners who appoint them. Unfortunately, the court declined to go further and invalidate the procedure by which the members of the board are selected in the first place. While we feel the court should have more strongly questioned the validity of both the PCAOB and Sarbanes-Oxley itself, we take it as a welcome sign that the flaws of the entire edifice are receiving greater scrutiny. We look forward to more opportunities to roll back the excessive and counterproductive burdens imposed by the law and enforced by the board. CEI’s Sam Kazman and Hans Bader served as co-counsel in the case alongside Michael Carvin of the law firm Jones Day and the Free Enterprise Fund, a non-profit organization founded by investment professional Mallory Factor and current Wall Street Journal editorial board member Stephen Moore.

CEI’s 2010 dinner took place last week. The evening was a great success, earning rave reviews from attendees. The dinner featured as Master of Ceremonies Tom Donlan of Barron’s, and a keynote address from the Honorable Alex Kozinski, Chief Judge of the U.S. Ninth Circuit Court of Appeals. Judge Kozinski managed to make a lecture on antitrust law entertaining! CEI presented the 2010 Julian Simon Memorial Award to noted statisticians Stephen McIntyre and Ross McKitrick for their work in debunking the infamous “hockey stick” climate graph. >>The Senate’s Global Warming Circus
The U.S. Senate seems determined to divest itself of its reputation as “the world’s greatest deliberative body” these days, as witnessed most recently during a debate over global warming. As Vice President for Strategy Iain Murray explains in a recent op-ed for the Washington Times, Sen. Lisa Murkowski (R-Alaska) was attempting last week to get her colleagues to stand up to the Environmental Protection Agency’s unconstitutional power grab over regulating greenhouse gases. While coming down to a close vote, her resolution of disapproval against the EPA’s scheme was ultimately defeated – though  by some of the most disingenuous and misleading rhetoric heard on the Senate floor in some time. As Senior Fellow Marlo Lewis points out, though, while falling short of a legislative victory, Sen. Murkowski succeeded in scoring an important political victory.

>>Senate Defends EPA Power Grab; Votes Down Resolution
On Thursday, 53 members of the U.S. Senate went on record supporting economy-busting global warming regulations from the Environmental Protection Agency. The resolution, S.J.Res.26, introduced by Senator Lisa Murkowski (R-Alaska) would have stopped the EPA from ‘enacting’ controversial global warming policies through the regulatory back door.  Specifically, it would have overturned EPA’s finding that greenhouse gas emissions endanger public health and welfare. The endangerment finding is both a trigger and precedent for sweeping policy changes never approved by Congress. Read more of what CEI has to say about the resolution:

Tired of the long lines and excessive bureaucracy that characterize modern air travel? So are we. In a new American Spectator article, CEI Vice President Iain Murray identifies three reforms to the Transportation Security Administration that would reduce waiting lines, trim agency waste, and improve security. Until Congress scraps the TSA and restores the private sector’s proper role in providing competitive and effective transportation security, the TSA should allow airports to opt-out of federal security screening and adopt a sensible risk model that would reduce costs while improving safety.

>>CEI Fights Government Campaign to Regulate the Internet
Bureaucrats at the Federal Communications Commission want to impose new rules on Internet providers, opening the door to greater government regulation of the Internet. To counter this serious threat, CEI has joined with several other free market groups to ask Congress to step in and defend Internet freedom. This week, CEI’s Ryan Radia spoke alongside leading activist group presidents and a member of Congress at a Capitol Hill press conference. Radia called on Congress to enact a new Communications Act for the 21st century – a comprehensive deregulatory agenda aimed at unleashing competition, innovation, and choice. Watch the news conference here (CEI remarks begin at 20:18).


>>Crews to FCC: First Amendment Doesn’t Need A Bailout
Wayne Crews, CEI Vice President for Policy, filed comments (PDF) with the FCC on May 7 in the agency’s “Future of Media” proceeding. Crews argued that the FCC’s duty is to expand communications liberty, not further subjugate private media to government control. The only prerequisite for free speech, Crews argued, is freedom. Crews summarized his FCC filing in an op-ed last Wednesday in the Washington Times.

Does the Climate Bill Have a Chance?

The chance that the Senate will pass a comprehensive energy-rationing (a k a climate) bill this year remains close to zero. BP’s big oil spill in the Gulf changes very little. The global warming movement peaked last June 26 when the House passed the Waxman-Markey bill. When members went home for the Fourth of July, many who voted for it discovered that their constituents were angry and mobilized. Seeing the public reaction, the Senator majority leader, Harry Reid, dropped plans to move a cap-and-trade bill before the August recess and turned to health care reform. It’s been all downhill since then. The Kerry-Boxer bill, which is very similar to Waxman-Markey, passed the Environment and Public Works Committee last fall, but it was clear that it couldn’t get 51 votes, let alone 60, on the floor. That’s when Senator Kerry began working on a “middle-of-the-road” package with Senators Graham Lieberman.

This week, CEI filed a complaint with the Federal Trade Commission against General Motors, arguing that GM’s recent ad campaign misleads consumers to believe that the company has repaid its bailout loans in full. In reality, GM only paid back about ten percent of these funds, and it used other government funds to do so. The complaint got major coverage in the USA Today, ABC, Michelle Malkin, the Wall Street Journal Blog, AOL News, Advertising Age, the Drudge Report and Instapundit.
